Plain-language summary

  • The preview is free. You owe the build fee only after you approve the preview and ask us to launch.
  • The care plan is month to month. Cancel it in writing at least 30 days before the next billing date.
  • We do not promise rankings, leads, revenue, or that a site meets a legal or accessibility rule.
  • You are responsible for the accuracy of what you ask us to publish, and for the rights to materials you supply.
  • Our liability is capped at the fees you actually paid us in the 3 months before a claim.

This summary is a reading aid. If it and the terms below ever disagree, the terms below control.

1. Who we are

These terms are between you and Local Mark Sites (“we,” “us”). Our contact details are hello@localmarksites.com and 304 E Pine St #1158, Lakeland, FL 33801, United States.

They cover the marketing site you are reading, a free preview, a paid website build, and the monthly care plan. If a written proposal you and we both sign conflicts with these terms, the signed proposal controls for that project.

2. The free preview

A preview is a complimentary concept, usually of a homepage, based on what you tell us. It is not a promise of leads, rankings, revenue, or a particular launch date. We may decline any project, including after we have seen your details.

The preview stays our property until the build fee is paid. You will not publish it, hand it to another vendor to reproduce, or treat it as a finished site. If you do not approve it, you owe no build fee, and you do not receive the files.

We may adjust a preview once. Further rounds are new work and may be quoted.

3. The build fee

The build fee is the one-time price for the approved site, as quoted for the plan you choose. It is due when you approve the preview and before we launch, unless a signed proposal says otherwise.

Approval means a clear yes by email or another written message. Silence is not approval. Once you approve and pay, the build fee is earned. It is not refundable except where the law requires a refund.

4. The monthly care plan

The care plan starts at launch and renews monthly until it is canceled. It covers hosting we provide, the security certificate, routine software updates, and the small edits described in your plan (text, photos, hours, prices, and similar). It does not cover a new page, a redesign, advertising, logo design, print, or custom features, unless we quote them.

Edit time that you do not use does not roll over. We schedule edits in a reasonable order. “Faster turnaround” on a higher plan is a priority in our queue, not a same-day promise.

Either of us may cancel the care plan by email at least 30 days before the next billing date. You will pay through the end of that notice period. A month that has already started is not refunded.

Within 14 days after the care plan ends, we will send you a copy of the site files as they then exist, and the logins for accounts that are in your name. Hosting we provide stops at the end of the paid period. Domains registered in your name stay yours; you are responsible for renewing them.

5. What we do not promise

We do not guarantee search rankings, traffic, leads, bookings, calls, reviews, or revenue. A website is one part of how customers find you. Results depend on your trade, your market, your photos, your competitors, and on services we do not control.

We do not provide legal, tax, insurance, licensing, or accessibility advice. We do not warrant that any site meets the Americans with Disabilities Act, the Web Content Accessibility Guidelines, state privacy laws, advertising rules, or any other law or standard. You are responsible for having the right advisors and for the claims on your site.

We do not guarantee uninterrupted hosting. Maintenance, providers we rely on, and events outside our control can take a site offline. We will work to restore hosting we provide within a reasonable time.

Time ranges we mention on the marketing site are typical, not a deadline, unless a signed proposal sets a date.

6. Your content and licenses

You are responsible for the accuracy of the business information, prices, license numbers, insurance statements, and other claims you ask us to publish. You will review them before launch and whenever you ask us to change them.

You are responsible for having the rights to text, photos, logos, fonts, music, and any other material you supply — including stock licenses and permission from the people in the photos. You will not ask us to publish anything unlawful, infringing, or misleading.

You grant us a license to use what you supply solely to do the work. You keep ownership of your materials and your trademarks.

7. Our work

After the build fee is paid, we grant you a non-exclusive license to use the design and front-end code of the launched site for your business. We keep ownership of underlying tools, know-how, and any material that is not unique to you, and we may reuse general layouts and techniques that do not include your confidential information.

We may link to the live site as an example of our work unless you opt out by email before launch. The concept designs on this marketing site are fictional. They are not clients and not reviews. We will not invent testimonials.

8. Fees

Prices on this site are in US dollars and can change for new projects until you approve a quote. You pay any taxes that apply to the purchase, other than taxes on our net income. If a payment fails, we may pause edits and, after notice, hosting.

9. Disclaimers

Except where the law does not allow a disclaimer, the site, the preview, and the care plan are provided “as is.” We disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement, and any warranty that the work will be error-free or will produce a business result.

10. Limitation of liability

To the fullest extent allowed by law, Local Mark Sites and its owners and contractors will not be liable for lost profits, lost leads, lost rankings, lost data, or any indirect, incidental, special, or consequential damages, even if we were told they were possible.

Our total liability for any claim arising out of these terms, the marketing site, a preview, a build, or a care plan is limited to the fees you actually paid us under the relevant plan during the 3 months before the claim arose. If you paid nothing in that window, our liability is limited to zero dollars beyond what the law refuses to let us limit.

These limits do not apply where the law forbids them, including liability that cannot be limited for gross negligence, fraud, or willful misconduct, or for death or personal injury caused by our negligence where a statute says so.

11. Your responsibility if a claim is about your materials

You will defend and hold harmless Local Mark Sites against claims by a third party that arise from materials you supplied, claims you asked us to publish, or your use of the site in a way these terms do not allow — including claims that you lacked the rights, or that a business claim was false. You will cover the resulting damages and reasonable attorney’s fees, except to the extent a court finds the claim was caused by our own gross negligence or willful misconduct.

12. This marketing site

Sample projects here are fictional concept designs. Prices shown on this site are examples and may change. The price that applies to you is the one we confirm in writing before you approve a build.

We may remove or change this marketing site at any time.

13. Changes

We may update these terms by posting a new version. For an active care plan, we will email material changes at least 30 days before they apply. You may cancel before they take effect. The terms in force when you approved a build govern that build fee.

14. Governing law

These terms are governed by the laws of the State of Florida, excluding its conflict-of-law rules. The state and federal courts located in Polk County, Florida are the exclusive venue, except that either party may bring a qualifying claim in small-claims court.

If a provision cannot be enforced, the rest stays in effect. A delay in enforcing a right is not a waiver.
